The immigration controversy shadowing Democrat Congresswoman Ilhan Omar of Minnesota is escalating, receiving its first official confirmation from inside the White House. Tom Homan, President Donald Trump’s border policy chief, confirmed in an interview on “The Sunday Briefing” that federal enforcement authorities are conducting an active criminal investigation related to Omar. Homan declined to reveal what evidence has been gathered so far, citing an ongoing proceeding, but made clear the law will be enforced without compromise.
3+When Homan was asked directly whether the federal government has proof that Omar committed immigration fraud or deception to obtain citizenship, he answered carefully: “I know things are going on, but I can’t give specifics of what’s happening.”
Still, Homan laid out the guiding legal principle: “If someone committed an immigration violation, if someone committed marriage fraud or anything like that, regardless if they’re a congressman or not, no one’s above the law. So, I’ll leave it at that. We’ll let HSI, Homeland Security Investigations, continue the investigation.” When pressed again to confirm whether an investigation is underway against Omar herself, he replied: “I’m confirming that ICE is, yeah — look, I said months ago that there’s something that’s been reported and needs to be looked at.”
3+The roots of the affair lie in a persistent claim Omar’s critics have raised for years: that she previously married a man named Ahmed Nur Said Elmi—who critics allege is actually her biological brother—in order to enable him to obtain legal status in the United States.
Omar, for her part, has rejected the claim repeatedly over the years, denied any family relationship to Elmi, and characterized the accusations as “bigoted lies” stemming from political persecution. To this day, no evidence or official documents proving the two are siblings have been presented to the public, and Homan didn’t present such data in the interview either.
3+Homan’s statement joins a wave of sharp declarations from Trump administration leadership. Just days earlier, Homeland Security Secretary Markwayne Mullin declared in a podcast interview: “”Something’s going to happen. … We know that she married her brother to try to bring him to the United States. We know he now lives in London.”
Mullin added that the investigation may expand beyond the marriage itself to examine how additional family members immigrated and illegal activity surrounding their entry to the United States in the first place. According to him, if it’s proven that a person wasn’t eligible to stay in the country from the outset—it could lead to revocation of status and deportation. Mullin, too, hasn’t presented the evidence on which he bases his statements.
Additionally, Vice President J.D. Vance addressed the issue back in May, noting that the Justice Department is examining suspicion of immigration fraud by Omar: “You read the things about Ilhan Omar … who she married and whether she didn’t marry this person or that person,” Vance said then. “It certainly seems like something fishy is there, but everybody’s entitled to equal justice under the law.” Earlier still, in March, Vance revealed he had discussed options for legal action with senior White House immigration advisor Stephen Miller, and even stated emphatically: “We think Ilhan Omar definitely committed immigration fraud against the United States of America.”
3+Beyond the investigation itself, Homan detailed the legal consequences of fraud in naturalization proceedings: “If someone lies through that process to becoming a citizen, and we can prove they, in fact, lied or misrepresented themselves, we can absolutely denaturalize them. We’ve done it before many times over the last 40 years I’ve been around, so it’s a process.”
At this stage, investigators haven’t presented public findings, no documents or testimony have been released, and no indictment of any kind has been filed against the congresswoman. The central significance right now is declarative and political: the federal government has moved from dealing with rumor-level matters to official confirmation of an active criminal investigation.
